BSchoolForTheBlock Terms of Service

Oct 13, 2026 · @BSchoolForTheBlock

Overview

Welcome to BSchoolForTheBlock! The terms "we", "us" and "our" refer to BSchoolForTheBlock ("BSchool"). BSchoolForTheBlock operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with Shopify builds, site management, brand management, and related professional services (the "Services"). BSchoolForTheBlock is powered by Shopify Inc., Shopify Commerce Singapore Pte. Ltd or Shopify International Limited, depending on where BSchoolForTheBlock is located, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service") describe your rights and responsibilities when you use the Services. Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as cancellations, refunds, warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our privacy policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services. These Terms of Service do not limit any rights you may have under applicable consumer protection laws or any other non-waivable statutory rights.

1. Access and account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To use the Services, including accessing or browsing our online store or purchasing any of the services we offer, you may be asked to provide certain information, such as your email address, billing, and payment information. You represent and warrant that all the information you provide in our store is correct, current and complete and that you have all rights necessary to provide this information. You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

2. Our services

We have made every effort to provide an accurate description of our services in our online store. Each service page lists what is included and its price. All service descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any service at any time and may limit the number of clients or spots we offer for any service, on a case-by-case basis.

Each service has its own terms in sections 8 through 11. Those terms apply in addition to the rest of these Terms of Service.

3. Orders

When you place an order, you are making an offer to purchase and authorize us and our payment processors to charge your selected payment method for the total amount of your order, including any recurring charges for subscription services. BSchoolForTheBlock reserves the right to accept or decline your order for any reason at its discretion, subject to applicable law. Your order is not accepted until BSchoolForTheBlock confirms acceptance. We must receive and process your payment before your order is accepted. In the event that we do not accept, make a change to, or cancel an order, we may attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made. Cancellations and refunds are handled solely in accordance with section 7 and the service terms in sections 8 through 11. This does not limit any rights you may have under applicable law. You represent and warrant that your purchases are for use in your own business or brand and not for resale to others.

4. Prices, billing, and subscriptions

Prices, discounts and promotions are subject to change without notice. The price charged for a service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms of Service. If there is a conflict between the terms for a promotion and these Terms of Service, the promotion terms will govern.

Some services are subscriptions. Subscriptions are charged automatically through our store on each billing date until cancelled under section 7. Your billing date is the day of the month you signed up. If a payment is not received within 3 days of its billing date, all work pauses until it is paid. A short grace period may be given at our choice. Sessions missed because of a late payment are not made up or refunded.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. You represent and warrant that (1) you are authorized to use the payment method you provide, (2) that the information you provide for such payment method is true, correct and complete, (3) charges incurred by you will be honored by the provider of your payment method, and (4) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.

5. Service delivery

Our services are delivered digitally, through your accounts, email, and scheduled calls. Nothing is shipped. All timelines are estimates and are not guaranteed. We are not responsible for delays caused by you, third-party platforms, or events beyond our reasonable control, including natural disasters, severe weather, utility or telecommunications outages, cyber incidents, governmental actions, or other similar events.

6. General service terms

These terms apply to every BSchool service.

Independent contractor relationship. BSchool is an independent contractor, not an employee or partner. BSchool sets its own schedule, uses its own tools, and decides how the work gets done. You do not handle BSchool's taxes, benefits, or insurance. These terms cover the work only and do not create a job or a partnership.

Support and availability. Support is available Monday through Friday, 10am to 7pm EST, by text, email, or scheduled call. Messages received outside those hours are answered the next business day. This keeps communication focused on the agreed scope and project hours.

Work sessions. All work sessions, other than the free Discovery Call, are 1 hour.

Your role. Timely feedback and cooperation are required to keep work on schedule. Delays in sending materials, approvals, or feedback may delay delivery and shift timing.

Scope of work. Each service covers what is listed on its service page and in these terms only. New requests, such as extra design, branding work, or larger custom store features, need a separate quote or agreement.

Ad spend, marketing costs, and third-party tools. You pay for all marketing and advertising costs, including ad spend and promotions. You also pay for any third-party tools or apps the work needs, such as your Shopify plan, email or text message tools, ad accounts, design tools, or scheduling tools with monthly fees. Our fees cover BSchool's work and its own tools only. As part of the service, BSchool may help choose, set up, and manage these tools. The accounts stay in your name. The final choice and cost of any outside tool stay with you.

Third-party vendors and venues. BSchool may bring in trusted vendors when needed, such as music production, video production, songwriting, photography, design, or studio time, and may use current or future venue relationships for shows, listening parties, pop-ups, and other events. These are separate businesses and are not part of our fees unless clearly stated. BSchool is not responsible for their prices, availability, delays, cancellations, actions, or results. Any added cost, booking, or vendor fee is discussed with you first and needs your approval.

Results. BSchool gives the agreed support, strategy, and work with care and consistency, but results are not guaranteed. Growth, sales, reach, streams, bookings, and other outcomes depend on many outside factors, including your consistency, audience response, platform changes, and market conditions. BSchool is not responsible for specific numbers or guaranteed results.

Our commitment. BSchool gives every client honest effort, thoughtful support, and steady care. The goal is real progress, a stronger brand, and clear structure with consistent action, done with focus, good faith, and your best interest in mind.

7. Cancellations

You can cancel in either of two ways:

  • Subscriptions: cancel in your customer account on our store, or email us.

  • One-time purchases, like the Build or Full Cycle: email us at mgmt@BSchoolForTheBlock.com.

Refund windows are counted from the date you cancel in your account or the date we receive your email, whichever comes first. Cancelling in your account stops future charges. Any refund owed under your service's schedule is issued by BSchool after the cancellation.

Final month after week 2. If you cancel a subscription after the first 2 weeks of a billing cycle, you still owe the final month under your service's terms, even if cancelling in your account stopped the automatic charge. By purchasing a subscription, you authorize BSchool to charge that amount to the payment method on file. If the charge can't be made, BSchool will send you a private payment link for the balance, and once it is paid, your account is settled. If the balance is still unpaid after attempts to settle it, BSchool may pursue any unpaid amounts through collections, as permitted by law.

Why the 2-week window. Work made in one month is delivered the following month. For example, if you signed up on the 1st, your billing date is the 1st of each month, and you have until the 14th to cancel without being charged for the next month. After the 14th, next month's work is already in progress, so the next month's payment covers those deliverables.

Each service has its own cancellation and refund terms in sections 8 through 11. Work stops once a refund is given. Work already completed stays billable.

8. Custom Shopify Build

How it works. The Build is a one-time payment, due in full at checkout. Purchasing the Build covers the full build and schedules your intake session. The Build takes 4 weeks from your intake session:

  1. Weeks 1 and 2: your site is built, including 2 design calls, 1 hour each.

  2. Week 3: revisions.

  3. Week 4: 2 training calls, 1 hour each, and launch prep.

The Build includes 4 calls in total. After launch, the Build includes 1 month of email support.

Launch. Your site goes live only when you approve it. If you are not ready, your site can be held at no cost for up to 1 year. You start your Shopify plan when you are ready to launch and pay Shopify directly.

Refunds. Refunds are based on when we receive your cancellation email, counted from your intake session. If you cancel after paying but before your intake session, it counts as week 1.

9. Site Management

How it works. Site Management is a monthly subscription for ongoing store maintenance and updates after launch. It is billed monthly for up to 12 months, and then the plan ends. There is no minimum, but we suggest at least 3 months for best results, because store updates need time to generate data.

Cancellation. Cancel within the first 2 weeks of a billing cycle, and your plan ends with no further charges. The refund schedule below applies. If you cancel after the first 2 weeks, you will be charged for one more month. All services for that final month are completed, and then the plan is cancelled.

If you cancel before the suggested 3 months, BSchool is not liable for any unmet deliverables or results.

10. The BSchool Engine

How it works. The Engine is a monthly service that runs in 3-month cycles. Month 1 is the build month, when we set the strategy and bulk-create your content and campaigns. Content made in month 1 is scheduled to start posting in month 2. In months 2 and 3, we run your content, campaigns, and ads, and close each cycle with a 90-day strategy review call. You record the footage for your content on your phone or camera, with direction from us on what to capture, and we edit it. In-person shoots may be available depending on your location and our service area. You approve all content before it posts.

Plans and terms.

  • Monthly: billed monthly for up to 12 months, and then the plan ends. There is no minimum, but we suggest at least 3 months for best results, because marketing needs time to generate data.

  • Full Cycle: one payment up front for one 3-month cycle, with no automatic renewal. When the cycle ends, you can continue with the 1-Year Renewal or stop.

  • 1-Year Renewal: a 12-month contract that locks in your Full Cycle rate for each 3-month cycle. It is paid quarterly, once every 3 months, for 4 payments. Available to clients who have completed a Full Cycle.

Cancellation. Cancel within the first 2 weeks of a billing cycle, and your plan ends with no further charges. The refund schedule below applies. If you cancel after the first 2 weeks of a Monthly billing cycle, you will be charged for one more month. All services for that final month are completed, and then the plan is cancelled.

Monthly: you are charged for one more month, all services for that month are completed, and then the plan is cancelled. Full Cycle and 1-Year Renewal: the current cycle is completed with no refund

If you cancel before the suggested 3 months, BSchool is not liable for any unmet deliverables or results.

11. Discovery Call

The Discovery Call is a free 45-minute call. Booking it does not commit you to buying any service. Calls are scheduled through our booking page and can be rescheduled from your confirmation email.

12. Confidentiality and account access

  • Shared account access, including your store, social media accounts, ad accounts, email or text platforms, and other tools we help manage, is kept private, secure, and limited to the agreed work.

  • Passwords, data, private information, and BSchool's tools, systems, methods, and strategies are kept confidential by both sides. Nothing is shared, reused, or given to others outside the work.

  • Access is used only for the work connected to your service, such as posting content, making updates, improving performance, and managing the tools that support the project. It is never used for anything personal or unrelated.

  • Your accounts and data stay in your name. You can remove or change BSchool's access at any time.

  • Nothing is posted or reused without your approval.

  • Login information is deleted when the work ends.

13. Accessibility (ADA)

BSchool builds and updates every store with accessibility in mind, following the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA as a guide. This includes real text instead of images of text, alt text on every image BSchool adds, readable color contrast, clear headings, and navigation that works with a keyboard. Content, images, and third-party apps added by you or app makers are outside BSchool's control. BSchool does not guarantee full ADA compliance or protection from accessibility claims. You are responsible for keeping content you add accessible.

14. Intellectual property

Our Services, including but not limited to all trademarks, brands, text, images, graphics, video, and audio on this website, are owned by BSchoolForTheBlock, its affiliates or licensors and are protected by U.S. and foreign trademark, copyright and other intellectual property laws. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on this website without our prior written consent. BSchoolForTheBlock's names, logos, product and service names, designs, and slogans are trademarks of BSchoolForTheBlock or its affiliates or licensors. You must not use such trademarks without the prior written permission of BSchoolForTheBlock. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

Work we create for you. BSchool's tools, systems, and methods stay with BSchool. What BSchool creates for you is for running and growing your own business. It may not be resold, shared, or given to others to use for their business. You are responsible for all content you provide and confirm you have the right to use it. BSchool is not responsible for copyright issues, platform actions, or results like reach, limits, or account changes, since those platforms are outside its control.

15. Optional tools

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

16. Third-party links

The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk. We are not liable for any harm or damages related to your access to any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

17. Relationship with Shopify

BSchoolForTheBlock is powered by Shopify, which enables us to provide the Services to you. When you use the Services, your device communicates with Shopify's systems to deliver the Services. Section 18 explains how Shopify uses and processes information from these interactions. However, any sales and purchases you make in our Store are made directly with BSchoolForTheBlock. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and BSchoolForTheBlock, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with BSchoolForTheBlock.

18. Privacy policy

Our privacy policy explains how we may collect, use, and disclose certain personal information from your use of the Services. By using the Services, you acknowledge that you have read this privacy policy. Because the Services are hosted by Shopify, as you browse and interact with the Services, Shopify collects, uses, processes, and stores personal information about your access to and use of the Services, including information about your transaction. Shopify may use this information for purposes including but not limited to providing, securing, and improving the Services; processing transactions; and helping prevent fraud on this website and on other websites that are powered by Shopify. Information collected when you visit or use the Services, including information collected automatically about your browsing activity, will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy and Shopify's privacy policy for more details on how we, Shopify, and our partners use your personal information.

19. Feedback

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content about our Services (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. Feedback does not include the content, materials, passwords, or data you share with us so we can do your work. Those stay confidential under section 12. You represent and warrant that: (1) you own or have all necessary rights to all Feedback; (2) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (3) your Feedback will comply with these Terms of Service. We are under no obligation to pay compensation for your Feedback or to respond to it. We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy.

20. Errors, inaccuracies and omissions

Occasionally there may be information on or in the Services that contains typographical errors, inaccuracies or omissions that may relate to service descriptions, pricing, promotions, offers, timelines and availability. We reserve the right to correct errors, inaccuracies, or omissions, and to change or update information or cancel orders if information is inaccurate, including after an order is submitted. If we cancel an order after payment has been collected, we will issue any refund required by applicable law.

21. Prohibited uses

21.1 You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with these Terms of Service; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm BSchoolForTheBlock, Shopify or users of the Services, or expose them to liability.

21.2 In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, AI tools (such as agentic AI) or automated or manual means to access the Services; or (f) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

22. Agents

22.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using a person's device, without direct supervision.

22.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 22.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

22.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

22.4 Agents must: (a) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (b) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (i) mimicking human behavior and interaction patterns, or (ii) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (c) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (d) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

23. Termination

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination. Your cancellation rights are in section 7 and sections 8 through 11. The following sections will continue to apply following any termination: Confidentiality and account access, Intellectual property, Feedback, Termination, Disclaimer of warranties, Limitation of liability, Indemnification, Severability, Waiver; entire agreement, Assignment, Governing law, Privacy policy, and any other provisions that by their nature should survive termination.

24. Disclaimer of warranties

The information presented on or through the Services is made available solely for general information purposes. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to the Services, or by anyone who may be informed of any of its contents.

EXCEPT AS EXPRESSLY STATED BY BSchoolForTheBlock, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT THE SERVICES WILL PRODUCE ANY SPECIFIC RESULTS. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO YOU.

25. Limitation of liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL BSchoolForTheBlock, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY. IN ANY CASE, BSchoolForTheBlock'S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS OF SERVICE EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

26. Indemnification

You agree to indemnify, defend and hold harmless BSchoolForTheBlock, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, (3) the content you provide and your use of your accounts, or (4) your access to and use of the Services. We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

27. Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. Nothing in these Terms limits any rights you may have under applicable consumer protection laws or other laws that cannot be waived by contract. If any part of these Terms conflicts with those rights, those rights will apply.

28. Waiver; entire agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). The one exception is a separate written service agreement signed by you and BSchool. Where that signed agreement and these Terms of Service differ, the signed agreement controls. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

29. Assignment

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

30. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. You and BSchoolForTheBlock consent to the exclusive jurisdiction and venue of the Superior Court of New Jersey, except where prohibited by applicable law. You and BSchoolForTheBlock consent to venue and personal jurisdiction in that court. Nothing in this section limits any rights you may have to bring claims in your local courts or rely on mandatory laws that apply in your place of residence.

31. Translations

The Terms of Service may be available in languages other than English. To the extent of any inconsistencies or conflicts between these English Terms of Service and Terms of Service available in another language, the most current English version of the Terms of Service will prevail. Any disputes arising out of these Terms of Service will be resolved in English unless otherwise determined by BSchoolForTheBlock (acting in its sole discretion) or as required by applicable law.

32. Headings

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

33. Electronic communications

By using the Services or placing an order, you agree that we may send you transactional and service-related communications electronically, including by email, in-account notice, or posting on the Services. These communications may relate to your orders, account, purchases, cancellations, refunds, these Terms of Service, or other Services-related matters. You are responsible for keeping your contact information current.

34. Changes to Terms of Service

You can review the most current version of the Terms of Service at any time on this page.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms of Service in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

35. Contact information

Our contact information is posted in our contact information policy.
